...Move Past Dobbs THIS IS THE YEAR TO... The Dobbs decision was dehumanizing. It was also a great pro-life win. The decision saved tens-of-thousands of babies from abortion and an equal number of women from the pain and guilt abortion brings. But it also came at a cost. WHAT WAS WRONG WITH DOBBS? The core issue is simple. Dobbs was decided based on state’s rights instead of human rights. To find state’s rights above that of the pre-born human required the literal dehumanization of the unborn. If the fetus is a human, then they have certain unalienable rights upon which the government shall not infringe. If they are not a human, then other rights (i.e. – the right of a state to make laws) can be found to be more compelling. When Dobbs was decided, the humanity of the unborn played little to no role in the decision. Instead, they found that the right to abortion is not constitutional and, therefore, each state could decide the question of abortion for themselves. Unfortunately, the decision is founded upon a purely hypothetical right to local governorship. This amoral foundation creates a vacuum of moral authority. It leaves no room for the defense of the unborn, only for the defense of constitutional federalism.
