Returning the issue to the people and their elected representatives returns it to a process in which the people can bring their arguments to their representatives, and have as much time as necessary to persuade them, and their fellow citizens, of the proper course of action. It is a process in which there are hearings and expert testimony, the back-and-forth process of debate and counterargument, amendments, more lobbying – and ultimately, if lawmakers are not carrying out the will of the people, the election process by which we can vote them out of office and elect those who represent us better. The Court is simply not built to have the time, process or personnel to handle all this adequately. Nor can you lobby, elect, or unelect a Supreme Court Justice.
